I was a Director of Food and Beverage working over 80 hours a week at a Country Club for over a year. One night, as with most nights, I was both Chef and Director. On May 19^th 2007, I was carrying a large tray of glasses into the kitchen that I managed. I have been in the food and beverage industry for over 25 years both in the front of the house and every position in the back of the house. Carrying large trays of glasses through a kitchen is routine but on this night my dishwasher spilled soapy water on the floor and didn’t put down any wet floor signs.

I slipped, flew into the air and landed backwards extremely hard onto my lower back. I was out for a minute or so came to with a bad headache and was in excruciating pain. That was the easy part of the story I have actually written portions of items during the year of events that have occurred to me.

Here are some of the highlights of surgeries and things that have happened to me during this year and are still getting worse.

9/26/07: Artificial Disc Replacement Surgery @ level 4-5

4/21/08: Spinal Cord Stimulator Surgery for lower back and due to nerve damage after 1^st surgery in left leg can’t walk, numbness in total leg

4/23/08: Very Large Blood Clot emergency surgery at stimulator pocket site

11/18/08: Extraction of old stimulator due to cauterization at time of blood clot surgery. Implant of new Stimulator with new company at the same time.

1/14/09: Extraction of 2^nd new stimulator after only 2 months of being in due to infection in back at pocket site. Admitted to hospital for 2 days for infection. Was informed after being on three of the most heavy duty anti-bionics that all metal from stimulators was removed from my back during extraction.

3/2009: Officially released from my back surgeon.

5/12/09: FCE from workers comp. I was unable to walk came to the test with a cane, I fell down at the test. I was vomiting at the test due to the pain. My attorney kept asking the tester when they were going to stop this test, this is ridiculous. This test just came back INVALID.

5/21/09: Due to FCE and them pushing me with their physical exam I was in such pain I had to go to the hospital but with complications of loosing bladder control for a few days because of massive sharp pain in my lower back in left thigh region. The hospital didn’t take any test except an x-ray and CT scan. They wanted to take an MRI which I said they should be able to with no problems since I was informed time after time everything was removed from my back from the stimulators. The X-ray report showed metal at the T-11 T12 region, that is where the lead anchor for the stimulator was!

6/4/09: IME: Doctor stated Failed Back, I would be on Chronic Pain management for the rest of my life. He said that with the metal in my back, I should go back and have the same surgeon look at it and take out those remaining pieces. That would be SURGERY # 6 and not any better. He said I am chasing surgeries. He had no answers as to why I can’t walk on my leg. He could not talk about any other problems that I’m having with my head. After my first surgery I was having blackouts, the workers comp neurologist found that I had a stroke, and seizure like activity and they took away my drivers license for three months. My attorneys said that my head is not an included body part.

3/19/09- 7/8/09 was how long it has been since any back or left leg injections at my Pain Clinic. Yes, everyone that's 4 months of no medical treatment from workers comp. They state they never received any authorization records or play their games but just stall tactics.

update on floating metal fragments in my back:

it's still there and there is no rush for workers comp just as you have read my previous surgeries with past infections they don't care. My first appointment to see yes, THE SAME EXACT SURGEON FROM BEFORE is on July 23rd 2009. That would be more than 2 months since they found the metal in my back in the hospital.

Really all of my private Doctors state it is much longer my

last surgery was on 1/14/09 so if our math is correct the FLOATING METAL FRAGMENTS HAVE BEEN IN MY BACK NOW SINCE JAN. 09. BUT I CAN'T EVEN GO TO ANY HOSPITAL FOR TREATMENT BECAUSE I GET TURNED AWAY DUE TO WORKERS COMP.

BEST ONE OF ALL: I HAVE ASK FOR MORE THAN 8 MONTHS THAT I WANTED A DIFFERENT NURSE CASE MANAGER BECAUSE SHE WAS BEING UN-ETHICAL. I WILL NOT GO INTO DETAILS HERE BUT WHAT I WILL SAY IS SHE WAS TELLING ALL OF MY SURGEONS, MY PAIN DRS. THAT THE REASON I WAS HAVING INFECTIONS WITH NO MEDICAL PROOF OR BACKGROUND TO BACK IT UP IS DUE TO A NICKEL ALLERGY.

ON MY PRIVATE INSURANCE, I TOOK A TRUE TEST PANEL ALLERGEN TEST FOR ALL METALS IN MY BACK SPENT OVER A WEEK OF TESTING AND LOTS OF $ TO DISPROVE THIS UN-ETHICAL CASE MANAGER WHO WAS SPREADING SLANDER, MALICIOUS, BAD FAITH MEDICAL PRACTICES AGAINST ME AND STALLING MEDICAL TREATMENT.

ALL TEST SHOWED THERE WAS NO NICKEL OR ANY TYPES OF METAL ALLERGINS THAT I HAD. THIS CASE MANAGER IS SUPPOSE TO BE AT MY APPOINTMENTS AS MY NURSE/ADVOCATE BUT SHE WENT BEHIND MY BACK AND MADE SURE I GOT NO MEDICAL TREATMENT WHICH I HAVE PROOF OF IT ALL.

ALL OF THIS IS NOW GOING ABOVE MY HEADS TO THE PROPER ATHOURITIES. THE DEPARTMENT OF INDUSTRIAL RELATIONS HAS BEEN REPORTED REGARDING NO MEDICAL TREATMENT FOR SO MANY MONTHS.

I NEED THE SUPPORT FROM OUR NETWORK THAT KNOWS HOW HARD WE TRY JUST TO LIVE THROUGH OUR DAILY PAIN. WHEN I HAVE BEEN SET BY A 2ND IME DR. OVER A MONTH AGO FOR A "FAILED BACK SYNDROM" AS WELL AS CHRONIC PAIN MANAGEMENT" FOR THE REST OF MY LIFE" BUT FOR OVER A YEAR AND STILL AS OF TODAY MY MEDICATIONS ARE BEING DENIED THERE IS SOMETHING VERY WRONG WITH THIS BROKEN SYSTEM.

IT'S THE UNITY OF US ON THE NETWORK STANDING TOGETHER AND EDUCATING EACHOTHER OF IF YOU HAVE BEEN HERE BEFORE OR KNOW THE RIGHT PERSON WHO CAN HELP MAKE A DIFFERENCE THEN PLEASE HELP.

8/5/09: IT'S A MIRACLE THE ONLY PAIN DR. IN VEGAS IS BACK AS MY TREATING DR. AFTER I FIRED MY WORKERS COMP. ATTORNEY'S. THIS WAS THE FIRST DR. WHO ACTUALLY THINKS "OUTSIDE THE BOX" WOW WHAT A CONCEPT. HE HAD THE 1ST TRIAL STIMULATOR PUT IN ME BACK IN 08 & IF IT WASN'T FOR HIM I WOULD NOT BELIEVE IN MEDICINE ANY MORE. Their workers comp Neurologist found all these items and never told me about them for over a month and a half. I found out about them by accident because I was having extreme headaches for over a week strait in December 2008. A different doctor read all of my reports and my treating neurologist kept apologizing to me about this grave mistake they made.

The mistake they made since they were workers comp. They dropped me as a patient about 2 months later with a letter stating I need to continue to see another neurologist. I am seeing a headache specialist (though my own private insurance) and he agrees that this is all related to my fall.

I never had any of these problems before. I am consistently vomiting at least 2-3 times a day from the rebound headaches and the pain from my back/leg.

I am going through foreclosure on my home now and workers comp won’t even approve my generic medication anymore. My private insurance is done with this as well. I spent over $6k last year out of pocket on co-pays, medications, driving, canes, medical equipment and everything else associated with workers comp not paying for anything.

Congresswoman, Dina Titus’ office as well as Harry Reid’s have even stepped in and called our mortgage company on our behalf because of my disability but no luck. The Disability Center tried to help me but since this is workers comp there isn’t much they can do. I am really being screwed by the system and that’s why I would like my story to get out there so that maybe some other media or agencies can help me and my family.

When I go to the hospital and they tell me you have metal fragments floating around in your back and no one is will do anything because it’s workers comp it’s pretty scary, especially because they know my history, and I had a stroke and seizure from past surgeries.

Brian, I know you are a great help and I learn loads from the blogs and the audios. It just seems that I am in a loosing battle and even with legal counsel they are not aggressive enough to say this is wrong 5 surgeries and I am in worse condition then when I started?

I appreciate if you can please call me I would like to get your feedback and would really like my story to be put on the site by you. I would like for people who are just starting out in workers comp to know what is really going on.
