On behalf of the Accessiblitiy and Disabiltloity Council (ADAC) this email is to let you know aou some new legislation that will impact how we opperate at ****.

 

The ADA Amendments ACt was signed by President George Bush on September 25, 2008 and becomes effexctive Jainuary 1,2009. It amends only Title I of the ADA which covers employment and will roaden the defination of disability under the Act. Disability is defined as a physical, or mental imparment that substaintially limits one or more major activities on an individual, a record of such an impairment or being regarded as having such an impariment.

                        "Major live activities" has been defined by the amendments and includes such thins as caring for ones' self, performing manual tsks, sleeping, breathing, learning, concentrating, thinking, and working. IN addidtion, those activities include major bodily funcions such as function of the immune system and digestive, respiratory, and circulatory functions. the amendmants will require that determinations of disability be made without regard to the effects of mitigating measures like medication, prosthetics, mobility devices and use of assistive technology; eyeglassess and contct lenses being the exceptions. zimpairments that are episodic or in remission such as epilepsy will be considered disabilitites if they would substantially limit a major life activity when active.

the impact on the *** may not be immediately know ad courts will have to interpret the amendments. HOwever, since more people will be covered under the definition of disability we likely will see increase in the number of accommodations requested by employees.A friend has Alzheimer’s.  The family received this notice from their place of employment:

  • Hi Diannel, this is Yvonne and I am new to disability digest. I think that we would see an increase in the number of accommodations. But I believe President Obama reversed all of Bushes' outgoing laws and ammendments. But don't take that as a quote. I just thought that was what Obama was talking about when is reversed all of Bushes' plans for 2009 and beyond. If you find out let me know because I am curious now. Bye for now. Nice to meet you.
